Terms of Service

1. Media Ownership & Intellectual Property

All raw footage, project files, working files, and source media captured or produced by 850 Media Productions remain the exclusive property of 850 Media Productions. This includes but is not limited to: camera original files, audio recordings, drone footage, B-roll, outtakes, and any unedited material.

Clients receive a perpetual, non-exclusive license to use all final, edited deliverables for their stated business purposes. Clients do not receive ownership of or access to raw footage, project files, or source media unless a separate Raw Media License is purchased in writing.

2. Raw Media License (Optional Add-On)

Clients who wish to obtain raw footage or project files may purchase a Raw Media License as a separate add-on. Pricing is determined per-project and must be agreed upon in writing before production begins. Even with a Raw Media License, 850 Media Productions retains the right to use clips for portfolio, promotional, and demo reel purposes.

3. Deliverables & Client Portal Access

All final deliverables are made available through our secure client portal. Portal access is provided for the duration of your active retainer or project agreement, plus 90 days after project completion or retainer cancellation. After that period, files may be removed from the portal. We recommend downloading all deliverables promptly.

4. Retainer Terms

Monthly retainer plans are billed on the 1st of each month and are non-refundable once billed. Unused shoot days or editing hours do not roll over to the following month. Retainers require a minimum 3-month commitment. After the initial term, retainers continue month-to-month and may be cancelled with 30 days' written notice.

5. Scheduling & Cancellations

Shoot days must be scheduled at least 7 days in advance. Cancellations with less than 48 hours' notice will count as a used session. Weather-related cancellations for outdoor shoots will be rescheduled at no charge. 850 Media Productions will make reasonable efforts to accommodate rescheduling within the same billing period.

6. One-Time Projects

One-time projects require a 50% deposit before production begins, with the remaining balance due upon delivery of final deliverables. Project scope, deliverables, and timeline will be outlined in a written project agreement. Additional revisions beyond two rounds may incur additional charges at our standard hourly rate.

7. Portfolio & Promotional Use

850 Media Productions retains the right to use clips, stills, and excerpts from all projects for portfolio, website, social media, demo reels, and promotional purposes unless a written confidentiality agreement is in place before production.

8. Limitation of Liability

850 Media Productions' total liability for any claim arising from services provided shall not exceed the total amount paid by the client for the specific project or billing period in question. 850 Media Productions is not liable for any consequential, incidental, or indirect damages.

9. Governing Law

These terms shall be governed by the laws of the State of Florida. Any disputes arising under these terms shall be resolved in the courts of Wakulla County, Florida.
